What is Process Serving?

Process Serving ensures that parties involved in legal proceedings are properly notified and that their due process is protected. The process server plays a critical role in seeing that this occurs by serving or delivering legal documents to an individual to ensure that they are informed about legal actions involving them. By officially notifying a person, the process server sees that they are afforded the rights granted to every American under the United States Constitution. They play a very important and essential role in the justice system.


The process server is impartial and has no ulterior motive regarding the legal proceeding. It is their role to make sure that important legal documents regarding the legal case get delivered, so the individual came be made aware of the proceedings and ensures that they have necessary information, thus protecting their rights.


The process begins when a legal action is initiated. The attorney of the person bringing the case prepares required legal documentation.  Once complete they hire a process server to deliver these documents to the opposing party in the legal case. The process server then uses a variety of methods to locate the individual and will go to locations where the person might be work, home or favorite hang outs. When doing so, specific guidelines and legal requirements must be followed.


Prior to handing the documents to the individual, the process server must verify the person’s name and them they must identify themselves and notify them that they are delivering legal documents. Proof of receipt is required by law. Typically, an affidavit or notarized statement listing date, time, location, and method of service must be completed and filed with the court. This process verifies that due process occurred and provides evidence that the persons rights were protected.

What Do Process Servers Do?

It is the job of a process server to ensure that individual who are involved in court cases receive crucial information and are notified about the pending legal action. They ensure that the legal rights of the person are protected under the law. Several essential steps are required, and sometimes investigative skills are necessary. Diligence and knowledge of laws is essential for a process server.


  • Receipt of Documents: Law firms, courts or individuals submit documents including summonses, complaints, subpoenas, writs, and other court documents the process server.


  • Review of Documents: A thorough review of the documents, including special instructions must be completed by the process server.


  • Locating Recipients: Various search techniques must be utilized, including research of public records, online databases, surveillance, social media searches, interviews with acquaintances or family, in order to locate difficult to find individual.


  • Serving Documents: Once the location of the individual is found, in person attempts are made to deliver to the recipient. In some cases, this is not possible so alternative methods may be used, according to local requirements. It is the role of the Process Server to make sure that the person understands the importance of the legal documents.


  • Proof of Service (Delivery): A “Proof of Service” document must be submitted to the courts to verify delivery to the recipient which includes the date, time, location, and manner of delivery. This legal record provides proof that the individual received the documents.
